Acceptance of Terms
By accessing or using Talkeez (“we,” “our,” “us”), you agree to these Terms of Service. If you do not agree, you may not use our services.
These Terms apply to:
- Parents and guardians
- Teachers, therapists, and specialists
- School districts and organizations
- Anyone accessing Talkeez tools
Description of Services
- Daily Activity App
- Free AAC Tool
- Communication logs
- Behavior and activity tracking
- AI-powered summaries and insights
- Parent–teacher–specialist communication features
Services may evolve over time.
Eligibility
Talkeez is designed for use with children, not by children.
- Children do not create accounts
- Adults (parents, teachers, specialists) manage access
- Districts may create organizational accounts
By using Talkeez, you confirm you are authorized to access the child data you enter.
User Responsibilities
You agree to:
- Use Talkeez only for lawful educational or therapeutic purposes
- Provide accurate information
- Maintain the confidentiality of login credentials
- Access only the child data you are authorized to view
- Follow district, school, or clinical policies
You may not:
- Misuse or attempt to disrupt the platform
- Reverse engineer or copy our software
- Use Talkeez for advertising or commercial exploitation
- Upload harmful, abusive, or inappropriate content
Data Privacy & Protection
Your use of Talkeez is also governed by our Privacy Policy. We follow best practices aligned with COPPA, FERPA, and HIPAA-adjacent standards (though Talkeez is not a covered entity). We do not sell personal information.
AI Features
Talkeez may offer AI-powered features such as behavior summaries, communication insights, pattern detection, and suggested strategies. By using these features, you agree that:
- AI outputs are assistive, not diagnostic
- AI does not replace professional judgment
- AI may process data to generate insights
- Data is not used to train public AI models
You may opt out of AI features at any time.
Content Ownership
A. Your Content
You retain ownership of child data, activity logs, AAC usage, messages, and uploaded content. You grant Talkeez a limited license to process this data solely to provide services.
B. Our Content
Talkeez owns the software, designs, logos, documentation, and AI models and algorithms. You may not copy, modify, or redistribute our intellectual property.
District & Organization Accounts
- Manage user access
- Configure permissions
- Request data exports
- Request deletion
Districts are responsible for ensuring staff follow privacy and security requirements.
Service Availability
We strive for high availability but do not guarantee uninterrupted service, error-free operation, or perfect data accuracy. We may update, pause, or discontinue features at any time.
Limitation of Liability
To the fullest extent permitted by law:
- Talkeez is provided “as is”
- We are not liable for indirect, incidental, or consequential damages
- We are not liable for decisions made based on AI outputs
- We are not liable for user-generated content or misuse
Your sole remedy for dissatisfaction is to stop using the service.
Indemnification
You agree to indemnify and hold Talkeez harmless from claims arising from misuse of the platform, unauthorized access to child data, violations of these Terms, or violations of district or clinical policies.
Termination
We may suspend or terminate accounts that violate these Terms, pose security risks, misuse child data, or abuse the platform. Users may request account deletion at any time.
Governing Law
These Terms are governed by the laws of the United States and the State of Maryland, unless otherwise required by district contracts.
Changes to These Terms
We may update these Terms as our services evolve. If changes are significant, we will notify users.
